Bernard Mornah Sues The Electoral Commission Over His Disqualification

Bernard Mornah, the flagbearer of the People’s National Convention (PNC), has filed a lawsuit against the Electoral Commission (EC) for disqualifying him from the 2024 presidential election.

In his application to the Accra High Court on September 24, 2024, Mornah is asking the court to stop the EC from any activities related to the presidential election until he is officially recognized as a “duly nominated candidate.”

He also seeks to overturn the EC’s decision to disqualify him and wants the EC Chairperson, Jean Mensa, to officially declare him as eligible to run for president. Additionally, he argues that the EC acted unfairly and arbitrarily in disqualifying him, violating Article 23 of the 1992 Constitution and his fundamental human rights.

Grounds

The dean of the University of Ghana Law School and Mr. Mornah’s attorney, Professor Raymond Atuguba, submitted the application for judicial review.

It is predicated on the claims that the EC disqualified him from running for office in violation of procedural irregularities, natural justice laws, and illegal actions.

The applicant claims that the EC disqualified him without providing him with a hearing or a chance to correct the claimed errors.

He claimed that such an act violates his fundamental human rights and due process as guaranteed by the Public Elections Regulations, 2020 (C.I. 127) and the 1992 Constitution.

Earlier On

On September 20, 2024, the EC dismissed 11 candidates and approved 13 to run for president in 2024.

Among the eleven candidates eliminated were Mr. Mornah, Kofi Asamoah Siaw of the Progressive Peoples Party (PPP), and independent candidate Janet Nabla.
