MPs Will Not Lose Their Seats For Declaring to Contest Future Elections on Another Party’s Ticket-Supreme Court

The Supreme Court has published the full judgement on the Afenyo Markin v. Speaker of Parliament case regarding the four MPs who have decided to go Independent in the 2024 general elections.  The suit seeking to invoke interpretation of article 97(1) (g) was heard and ruling was delivered  subsequently on Tuesday, November 12.

Per the judgement sighted by Dekia Media, the Supreme Court has indicated that a Member of Parliament does not lose his seat in Parliament by virtue of the fact that he or she wants to contest a future election on the ticket of another party other than the one on which ticket he was elected into Parliament.

 

They further stated that a Member of Parliament will vacate his or her seat however, if he or she decides to join another party while remaining in Parliament. That’s to say If you came to Parliament on the ticket of NPP and decided to go Independent or joined the NDC and still remain in parliament, you would have to vacate your seat. However, if you are elected to Parliament on the ticket of NPP and decide to contest the next general election on NDC’s ticket or as an Independent candidate without leaving the NPP side within Parliament, you should be allowed to complete your tenure until dissolution of Parliament.
