The supreme court, presided over by Chief Justice Gertrude Torkornoo, has set tomorrow, 12th November, to deliver the ruling for the substantive case regarding interpretation of Article 97 (1)(g) of the 1992 constitution today, November 11.
This comes on the heels of a ruling by the Speaker of Parliament, Alban Bagbin, which sought to declare four(4) seats in parliament vacant pursuant to article 97 (1)(g) which states that a member of parliament shall vacate his seat in parliament “if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as and Independent member.”
In effect, four (4) Members of Parliaments , Cynthia Morrison (Agona West), Kwadwo Asante (Suhum), Andrew Asiamah (Fomena), and Peter Kwakye Ackah (Amenfi Central) who had declared their intent to run as independent candidates were directed to vacate their seats ahead of the December 2024 elections.
The Member of Parliament for Effutu, Hon. Alexander Afenyo Markin, Constituency subsequently filed a writ to challenge the Speaker of Parliament’s decision to “oust” four Members of Parliament (MPs)
Attorney General and Minister of Justice, Godfred Dame, also filed his statement case at the Supreme Court on the action initiated by Afenyo Markin.
The Supreme heard the case in the absence of the Speaker of Parliament’s counsel and informed the court that ruling will be delivered tomorrow, November 12.
