High Court Throws Out Fake Drugs Charges Against Tobinco

Regarding accusations of bringing counterfeit medications into Ghana, the Accra High Court has ruled in favor of Tobinco Pharmaceuticals Limited (TPL) and Elder Dr. Samuel Amo Tobbin, the company’s group chairman.

On July 29, 2024, Her Ladyship Audrey Kocuvie-Tay gave this verdict, refuting the assertions of Dr. Stephen Kwabena Opuni, the former CEO of the Food and Drugs Authority (FDA).

The decision is the result of a five-year legal dispute that started on July 19, 2019.

Tobinco Pharmaceuticals issued a press release stating that the FDA under Dr. Opuni’s leadership constituted an abuse of authority and that the court found the claims to be unfounded.

“The court found evidence of coercion in obtaining confession statements from Elder Dr. Tobbin and Mr. Kamath, using documents prepared by the BNI with letterheads taken from Tobinco’s offices.

“The FDA’s prohibition of Tobinco’s products and the ban on Bliss GVS Pharma Limited’s exports to Ghana were ruled unlawful as they lacked proper authorization from the Minister of Health,” portions of the release read.

The statement also stated that the CEO and the company are feeling positive and applaud the court’s decision.
