The People’s National Convention (PNC) flagbearer, Bernard Mornah, filed a case contesting the Electoral Commission’s (EC) decision to ban him from the 2018 presidential elections, but it was dismissed by an Accra High Court.
In its decision on Monday, October 21, the court dismissed Mornah’s effort to reverse the EC’s disqualification of him.
Mr. Mornah requested a declaration claiming that his right to due process had been violated by the first respondent, Jean Mensa, and the second respondent, the EC, who decided to disqualify him without giving him a reason or a chance to be heard.
He maintained that the respondents’ acts were unfair, irrational, and in violation of Articles 23 and 296 of the 1992 Constitution.
In addition, Mr. Mornah requested that the court overturn the EC’s September 20, 2024, ruling that disqualified him from the 2024 presidential contest.
In a press release on September 20, the EC stated that 13 candidates, including Bernard Mornah, had been disqualified and cleared to run in the polls in December.
The EC clarified that in order to assure compliance with legislative criteria, a comprehensive examination of nomination forms filed between September 9 and September 13, 2024, led to the disqualification.
